The pursuit of justice in the past general election by the Labour Party led to a clash with the Independent National Electoral Commission (INEC), after a reaction to the statement by the legal team of the Labour Party and its candidate, Peter Obi, with present allegation of the commission’s refusal to respond to the subpoenas served on them.

The Party and Peter Obi are still challenging the outcome of the 2023 presidential election that ended with the declaration of Bola Ahmed Tinubu of the All Progressives Congress as winner.
Labour Party had in its earlier petition proceedings accused INEC of not granting them access to some of the sensitive election documents which they need to prove their allegation that Tinubu did not win the February, 2023 election.

While moving the motion for adjournment of the hearing on 14th June, 2023, the counsel for the petitioners, Livy Uzoukwu (SAN), further complained to the Presidential Election Petition Court that despite all the effort made by INEC to “consistently refuse the subpoena to produce documents,” victory will still come to Labour Party at the end.

Kemi Pinhero (SAN), in expression of his displeasure, reveal through a statement that implied that his client was uncooperative, counsel for INEC, said, “Don’t use INEC as a whipping boy.”
Pinhero said, “It has become a habit for them to look for somebody to whip. I am not privy to any discussion he has had with A.B. Mahmoud.
“It can’t be true that the receipt or the subpoenae were refused.”
