Appeal Court Orders ASUU To Resume Work With Immediate Effect

The Court of Appeal in Abuja has ordered members of the Academic Staff Union of Universities (ASUU) to call off the lingering strike and resume work immediately.
The appellate court gave the order today (Friday) in a ruling on an application by ASUU seeking permission for it to appeal against the order of the National Industrial Court which asked the striking lecturers to resume duty.
The court also granted leave to ASUU to appeal the interlocutory injunction of Justice Polycarp Hamman of the Abuja Division of the National Industrial Court of Nigeria on September 21, 2022 asking members of the union to resume work, while insisting that ASUU must obey the order of the lower court with effect from today, October 7.
The presiding judge, Justice Hamma Barka, gave a stern warning that if ASUU failed to comply with the court order, it automatically lost the right to appeal the ruling of the lower court.
The three-man panel led by Justice Hamma Barka said for ASUU to file its notice of appeal within 7 days, it must show evidence that its members have resumed work immediately.
The panel also ruled that failure to adhere to the order will make the appeal incompetent before Court of Appeal.
